1.PUBLIC PROSECUTOR The Court Made the FoIIowI-nq Order:- This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3,'seeking regular bail, in Crime No.15 of 2025 of Panjani Police Station, Chittoor District, 'registered for the offences punishable under Sections 318(4), 316(2), 351(2), 61 (2) and 111 (2)(b) read with 3(5) of the BNS. 2. Case of the prosecution, in brief, is that when the defacto complainant visited Rayalapeta VIIIage, Al introduced himself as a Stock Exchange Broker and lured him to deposit amounts through phonepe into his accounts and also the accounts of other accused and in that process, the accused received a sum .-. /
i of Rs.72,21,000/- on different dates to the different bank accounts.
That the accused returned an amount of Rs.27,21,000/-to the defacto complainant as the said sum was profit, gained in the share market and thereafter, the accused postponed the amount and did not repay the balance amount, The case was reported and it was registered as a case in Crime No.15 of 2025 and investigated into. 3. Heard. Perused the record. 4. A perusal of material on record goes to show that except the offence under Section 111(2)(b) of BNS, all other offences alleged as against the petitioner are punishable with imprisonment of less than seven years. According to the learned counsel for the petitioner, the offence under Section 111 (2)(b) of BNS would not attract as against the petitioner herein. He further submits that the petitioner was arrested on 05.04.2025 and since then he has been languishing in jail. Moreover, the investigation _in the present crime is not concluded and the charge sh~eet is not yet filed even after completion of 90 days. 5-. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/A3 on the following conditions. i) The petitioner/A3 shall be released on bail on his executing personal bond for Rs.10,000/-(Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned Judicial Magistrate of First class, Punganur. ii) On release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e. on every Saturday, between 10.00 am and 01.00 pm, till filing of the charge sheet. 6.
