Neutral Citation No. - 2025:AHC:39246-DB Court No. - 29 Case :- WRIT - C No. - 5532 of 2025 Petitioner :- Mohammad Tajim Respondent :- Union Of India And 3 Others Counsel for Petitioner :- Hina Shafiq,Rizwan Ahmad(Qureshi) Counsel for Respondent :- A.S.G.I.,Bimalesh Ch. Tripathi,C.S.C.,Sanjay Dwivedi Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioner is holder of a valid passport. He intends to go to Kuwait. A police clearance certificate is stated to be required for such purposes. The authorities, however, have not issued such certificate, on account of which, the petitioner has approached this Court. While entertaining the writ petition following orders were passed in the matter on 5th March, 2025:-
"Grievance is that the police authorities are refusing to grant clearance certificate to the petitioner which is mandatorily required for visiting Kuwait. This is so on account of his implication in Case Crime No.50 of 2018 under Section 429 IPC, Police Station Kanth, District Moradabad. It is stated that in this case, the petitioner has already made confession and upon imposition of penalty Rs.500/-, proceedings have been concluded. It is also stated that such proceedings or orders passed therein cannot constitute any valid basis for denying the police clearance certificate to the petitioner. Learned State Counsel for the State-respondents and Sri Sanjay Dwivedi,
learned counsel for the Union of India, pray for and are granted ten days' time to obtain instructions in the matter. Put up as fresh, once again, on 19.03.2025." Learned Standing Counsel has obtained instructions from the concerned police station, according to which, a penalty of Rs. 500/- has been imposed upon the petitioner in Case Crime No. 50 of 2018, under Section 429 IPC. Copy of the instructions is taken on record. Though the petitioner was earlier implicated in a matrimonial dispute, but a final report has been submitted, which is yet to be accepted by the concerned Magistrate. As of now there does not appear to be any legal hindrance in issuance of police clearance certificate to the petitioner. In such circumstances, we allow the writ petition and direct the third
respondent to issue necessary certificate of police clearance in terms of the above observation within a period of two weeks from the date of presentation of a certified copy of this
order.
