JUSTICE PRAVEER BHATNAGAR Order 06/08/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 99/2025 registered at Police Station Sarthal, District Baran for the offence(s) under Sections 8/15 and 8/25 of NDPS Act. It is argued that recovered quantity of contraband article i.e. poppystraw is 29.93KG which is below commercial quantity. The accused petitioners are in custody since 03.06.2025 and the trial of the case will take considerable time therefore, the benefit of bail may be granted to the accused-petitioners. [2025:RJ-JP:30279] (2 of 2) [CRLMB-8001/2025] Learned Public Prosecutor opposes the grant of bail application Heard and perused the material available on the record. Considering the arguments advanced by learned counsel for the petitioners and looking to the fact that recovered quantity of poppystraw is 29.93KG which is below commercial quantity. The accused petitioners are in custody since 03.06.2025 and the trial of the case will take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners 1. Vishnu S/o Hardevram, 2.
