ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“to issue Writ of Mandamus or any other appropriate Writ
Order or Direction declaring the inaction of the Respondent authorities in preventing illegal constructions over Survey Nos. 94/2 and 100/3 of Paderu Village, Paderu Mandal, Alluri Sitarama Raju District despite the subsisting interim
order dated 25.04.2023 as arbitrary, illegal and violative of Article 14 and 300-A of the Constitution of India direct the Respondents 4 and 5 to immediately cease all construction activity and maintain status quo over the above lands direct the Tahsildar Paderu Respondent No. 3 to take immediate steps including involving police assistance to stop further violations Pass” The claim of the petitioners are that the unofficial respondents herein are proceeding with the illegal constructions in Survey Nos.94/2 and 100/3 of Paderu Village, Paderu Mandal, Alluri Sitarama Raju District, despite the subsisting interim order issued by Court of Agent to Government Agency District Judge Cum District Collector dated 25.04.2023. It is further submitted that even though the petitioner brought to the notice of the respondent authorities, the respondent authorities are not initiating any action against the un-official respondents i.e., respondent Nos.4 and 5 and further allowing them to proceed with construction activities. Hence the Writ Petition. 2. 3. On the other hand, learned Assistant Government Pleader for Revenue rd furnished written instructions submitted by the 3 respondent dated 20.06.2025, which reads as under:
“5. Reasons why application could not be considered. R-4: As per the Revenue records the subject land in Sy.No.94/2 and 100/3 are classified as Gayyalu (AWD) lands. Which is belongs to Govt, land. The petitioner and respondents are both of them Non-Tribal (B.C.B.Kummara Caste). The respondent’s forefathers have been issued certificate of possession to the above lands. I submit that as per the above interim orders. I have given instructions to the concerned filed staff i.e.. Village Revenue Officer and Village Surveyor of Paderu Village to stop the unauthorized constructions in this subject lands. In this Sy.No.94/2, the respondents not in possession and not constructed any building and no constructions were identified in Sy. No. 100/3 of Paderu Vilage of Paderu Mandal. 5A. Who is in possession of the subject lands:- On ground in respect of Sy.No.94/2 there are Two houses and Seven basements are exist and remaining land is vacant on ground belongs to different persons who are not covered in this Writ Petition as respondents. In respect of Sy.No.100/3 an extent of Ac.0.99 cents is possessing by the Respondent-4 with paddy fields and remaining extent of Ac.0.21 cents alienated to NH516E.”

On considering the submissions of both the learned counsels and on perusal of the written instructions furnished by the learned Assistant Government Pleader for Revenue, this Court finds that the respondent authorities are not allowing any illegal constructions as alleged by the petitioners. It is further observed that either the petitioners or the respondent Nos.4 and 5 are not the pattadars of the subject land. The written instructions further submit that entire land is classified as Government land and no construction activity is being carried out by the unofficial respondents, as alleged by the petitioners. By observing the same, the Writ Petition is disposed of. As a sequel miscellaneous application, pending, if any, shall also stand
