Respondent(s) PRAYER Writ petition filed under Article 226 of Constitution of India for the issuance of Certiorarified Mandamus to call for records of the impugned order in Lr No. 423/ CAI/AU/2025 dated 28.08.2025 passed by the 2nd respondent and quash the same and consequently direct the respondent to grant extension of affiliation to the petition Educational institution for the Academic year 2025- 26 and pass orders. For Petitioner(s): Mr.R.Kannan For Respondent(s): Mr.S.Arumugham Govt.Advocate For R1 And 4 Mr.U.Bharanidharan, Standing Counsel For R2 And R3 ORDER This writ petition has been filed challenging the impugned communication dated 28.08.2025 of the 2nd respondent and for a consequential direction to the respondent to grant extension of affiliation to the petitioner educational institution for the academic year 2025-2026. 2. When the writ petition came up for hearing on 29.10.2025, https://www.mhc.tn.gov.in/judis WP No. 34324 of 2025 the learned counsel for the petitioner submitted that whatever defects were pointed out by the University has been rectified and that the supporting documents are available to substantiate the same. In the light of this submission, this Court directed the learned counsel for the petitioner to file additional typed set of papers containing all those documents that supports the stand that has been taken by the petitioner. Accordingly, the relevant documents filed by way of additional typed set of papers was served on the learned Standing counsel appearing on behalf of the 2nd respondent University. 3. When the matter was taken up for hearing on 31.10.2025, the learned Standing Counsel appearing for the 2nd respondent University pointed out to various discrepancies in the documents and submitted that the petitioner has not rectified any of the defects that were pointed out by the University. In the light of this submission, this Court directed the documents to be circulated for the purpose of going through the same. 4. The matter was taken up for hearing on 05.11.2025 and this Court passed the following order:- https://www.mhc.tn.gov.in/judis WP No. 34324 of 2025 Pursuant to the earlier order, this Court had an occasion to go through the entire document. This Court finds that there is sufficient reason for the respondents for not granting affiliation. However, during the interregnum period, the petitioner has proceeded further and granted admission to students under the management quota. If the petitioner does not have the affiliation, these students will be left in lurch. 2. In view of the above, learned counsel for second respondent shall take instructions as to whether these students can be accommodated in other colleges for this academic year. Post this writ petition on 07.11.2025. 5. The case was again listed for hearing on 07.11.2025 and the following order came to be passed by this Court:- When the matter was taken up for hearing today, the learned Standing Counsel appearing on behalf of the Anna University produced the written instructions received from the Registrar. On going through the same, it is seen that insofar as the students who have joined in the Management Quota, if they are willing to join other Colleges, based on their willingness and vacancy position, they will be accommodated in the other Colleges. 2.The learned counsel for the petitioner seeks for some time. Post this case under the same caption finally on 11.11.2025. https://www.mhc.tn.gov.in/judis WP No. 34324 of 2025 6. When the matter was listed for hearing today, the learned counsel for the petitioner submitted that the petitioner will rectify all the defects pointed out by the University and will re-submit their request for recognition. In the meantime, the students who have joined under the Management quota can be accommodated in the other colleges, subject to their willingness. As and when, the petitioner rectifies all the defects and is granted recognition, those students must be permitted to join the petitioner institution through lateral entry. 7. The learned Standing counsel appearing on behalf of the 2nd respondent University submitted that those students who are willing to join other colleges can be accommodated in such colleges, subject to the availability of vacancies. The learned counsel further submitted that as and when the petitioner college rectifies all the deficiencies pointed out, they can resubmit the proposal seeking for recognition and the same will be considered by the 2nd respondent University. Insofar as the request made by the learned counsel for the petitioner seeking lateral entry of the students is concerned, the same will be dealt with by the University in accordance with the relevant regulations. https://www.mhc.tn.gov.in/judis WP No. 34324 of 2025 8. In the light of the above development, there shall be a direction to the 2nd respondent to identify the vacancy position and based on the willingness given by the students, who have been admitted under the Management quota, they can be accommodated in other institutions. The petitioner shall rectify all the defects pointed out and submit a fresh proposal to the 2nd respondent University and the same will be considered by the 2nd respondent university while taking a decision to continue with the recognition sought for by the petitioner institution. As and when such recognition is granted by the 2nd respondent University, it is left open to the 2nd respondent University to deal with the request made by the petitioner for permitting the students to join as a lateral entry and the same shall be dealt with in line with the relevant regulations. 9. This writ petition is disposed of in the above terms. No costs.
