Neutral Citation No. - 2025:AHC:32317 Court No. - 5 Case :- WRIT - A No. - 2904 of 2025 Petitioner :- Kamal Pathak Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Bipin Pal Singh Counsel for Respondent :- Satish Chaturvedi Hon'ble Ajay Bhanot,J. Shri Bipin Pal Singh, learned counsel appears for the petitioner. The petitioner has sought the following relief:
"(i) To pay the salary allowances, P.F. including interest from the date of compulsory retirement i.e. from 12.09.2006 to 27.05.2011." Admittedly, the petitioner was compulsory retired from 12.09.2006 to 27.05.2011. The petitioner was reinstated in service pursuant to an award of the labour court. According to Ms. Archana Singh, learned counsel for the respondents No.2 and 3, the award of the labour court has been duly executed. The petitioner is effectively seeking reliefs which were not granted by the labour court. The petitioner cannot claim something which was not granted by the labour court nor agitated by him at the time of execution of the award of the labour court. The delay of almost 14 years in approaching the Court is fatal to the case of the petitioner. The writ petition is dismissed for the above reasons as well as for the delay and laches.
