02/12.08.2025 The petitioner is apprehending his arrest in connection with Jari P.S. Case No.06/2025, registered for the offence under Sections 281, 317(5), 3(5) of the Bharatiya Nyaya Sanhita, 2023, Section 12(i) of Jharkhand Bovine Animal Slaughter Act, 2005 and Section 11(i)(iv) of Prevention of Cruelty to Animal Act, 1960, pending in the Court of the learned Sub Divisional Judicial Magistrate, Gumla.

Learned counsel for the petitioner submits that the petitioner happened to be the owner cum driver of the vehicle in question. He submits that the allegations are made that on the vehicle in question, bovine animals were being carried. He further submits that the petitioner has received notice under Section35(3) of the Bharatiya Nagrik Suraksha Sanhita and he has also replied to the same.

Learned counsel for the State opposed the prayer and submits that the petitioner is having criminal antecedent.

In light of the above and considering that notice under Section 35(3) of Bharatiya Nagrik Suraksha Sanhita has already been replied by the petitioner, he is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or sureties as the learned Court may deem fit and proper.
5. Accordingly, this application is disposed of.
