Instant bail application has been filed by petitioner under Section 483 B.N.S.S. in connection with FIR No.07/2025 registered at Cyber Police Station Kota, District Kota City for offences under Sections 318(4) of B.N.S. and 66 D of Information Technology Act. 2. Learned counsel for the petitioner submits that account of petitioner has been misused without his knowledge in order to commit cyber crime and petitioner has falsely been implicated in this case, he is in custody since long. There are no criminal antecedents against the petitioner and offence is triable by Magistrate, therefore, petitioner be released on bail. 3. Heard counsel for petitioner and learned Public Prosecutor as well as perused the material available on record. 5. Having considered the nature of offences, which are triable by the Court of Magistrate and the fact that petitioner is in custody since long, but without commenting on merits of the case, this Court deems it just and proper to release the petitioners on bail. 6. Accordingly, the bail application is allowed and it is ordered that the accused-petitioner Danish Khan S/o Babu Khan shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
