Singh, learned counsel along with Mr. W. Darakeshwar, learned Sr. PCCG for the FCI. At the Bar, it is submitted that during the pendency of the writ petition, the petitioner has been appointed as Road Transport Contractor on regular basis for transportation of foodgrains/allied materials etc. from RH Khongsang to FSD Sangaiprou and as such, the impugned NIT which is subject to regular appointment of the Road Transport Contractor for transportation of foodgrains/allied materials etc. from RH Khongsang to FSD Sangaiprou has become infructuous. In the circumstance, the cause in the writ petition does not survive. Learned counsel for the respondents also support the submission made by the learned counsel for the petitioner. Recording the submissions made at the Bar and taking into consideration the subsequent development, the writ petition is closed as infructuous. MC(WP(C)) No. 817 of 2024 is also closed.
