03/ 18.08.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Latehar (Mahila) P.S. Case No. 01 of 2025, registered under sections 126(2), 115(2), 85, 352, 351 (2), 3 (5), 109 of BNS and under section ¾ of D.P. Act, pending in the Court of learned Chief Judicial Magistrate, Latehar.

Learned counsel for the petitioner submits that petitioner happens to be husband of the informant and there is general and omnibus allegation against the family members. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that there is allegation of torture and case is also arising out of section 109 of B.N.S, Act.

Considering that petitioner happens to be husband of the informant and there is general and omnibus allegation against the family members and entire family members have been implicated, the petitioners are directed to surrender before the learned court within two weeks from the date of receipt/production of a copy of this order and the learned court will release the petitioners on terms and conditions and sureties as learned court deems fit and proper.
6. This anticipatory bail application is disposed of.
