JUSTICE MANASH RANJAN PATHAK ORDER 03-01-2025 Heard Mr. F. Z. Mazumdar, learned counsel for the applicant/petitioner and Mr. K.K. Parashar, learned Additional Public Prosecutor, Assam for the sole respondent. 2. The applicant as petitioner filed the connected BA No. 2895/2024 seeking bail in Sessions (Special) Case No.112/2023 arising out of Paltan Bazar Police Station Case No. 193/2023, presently pending before the Court of learned Special Judge (POCSO), Kamrup (M), Guwahati, in which she was arrested on 13.05.2023. 3. In the said BA No. 2895/2024, the petitioner in the cause title had shown her to be the son of Sri Tapan Bose. Similarly, in the affidavit annexed with the said bail application of the applicant/petitioner that was sworn by her brother Abhijit Bose stated that he has been authorised to swear the said affidavit on behalf of the petitioners. Moreover, in the filing slip filed with said BA No. 2895/2024, the petitioner had shown her to be a male as her gender instead of female. 4. By preferring the interlocutory application, being I.A.(Crl) No. 1217/2024 the applicant has prayed for correction of those typographical errors that occurred in the connected BA No. 2895/2024, so that effective orders can be passed in the interest of justice in said BA No. 2895/2024. 5. The applicant submitted that inadvertently in the cause title of her said BA No. 2895/2024, she has been shown to be the son of Tapan Bose, which should have been daughter of Sri Tapash Bose as been reflected in the forwarding reported dated 13.05.2023 submitted by the Investigation Officer of the case in said Paltan Bazar P.S. Case No. 193/2023. 6. By preferring the second interlocutory application, being I.A.(Crl) No. 1279/2024 Page No.# 3/3 in said BA No. 2895/2024, the applicant has prayed for correction of the cause title in her said BA No. 2895/2024. 7. Mr. Parashar, learned APP has no such objection in correction of such typographical mistakes that occurred in the connected BA No. 2895/2024 filed by the petitioner as applicant. 8. Considering the records of BA No. 2895/2024, forwarding report dated 13.05.2023 in said Paltan Bazar P.S. Case No. 193/2023, the charge-sheet dated No. 140 dated 03.07.2023 filed in said Paltan Bazar P.S. Case No. 193/2023, it is found that the applicant/petitioner namely, Utpala Bose is the daughter of Sri Tapash Bose, who is a charge sheeted accused No.5 in said Paltan Bazar P.S. Case No. 193/2023, who is in custody since 13.05.2023, presently, pending before the Court of learned Special Judge (POCSO), Kamrup (M), Guwahati in Session (Special) Case No. 112/2023. 9. After considering the materials on record and for the interest of justice, prayers made by the applicant in both the interlocutory applications, noted above, are allowed enabling the petitioner to make relevant corrections, noted above, in the connected BA No. 2895/2024 putting his initials and date on those corrections. 10.
