Heard Mr. S. M. Abdullah P, learned counsel for the accused applicant. Also heard Mr. R. R. Kaushik, learned Addl. Public Prosecutor for the State respondents and Mr. I. U. Choudhury, learned counsel assisting the P.P. appearing for the

The present application, under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been instituted praying for grant of regular bail to the accused, namely Golena Begum, who was arrested on 11.12.2024, in connection with Satgaon P.S. Case No. 177/2024, under Sections 126(2)/118(2)/109 of the Bharatiya Nyaya Sanhita, 2023. The Case Diary has been furnished before this Court. On perusal of the Case Diary as well as on examining the materials brought on record with regard to the injuries sustained by the wife of the informant, also considering the length of detention and the progress made in the investigation, this Court is of the considered view that the accused applicant is entitled to be enlarged on regular bail. Accordingly, the accused applicant is directed to be enlarged on bail on furnishing a bond of Rs. 25,000/-(Twenty five thousand only) along with two sureties of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), subject to the following conditions:-
(i) That the accused applicant shall continue to make herself available for interrogation by the Investing Officer as and when required;
(ii) That the accused applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or, to any police officer.
(iii) that the accused applicant shall not leave the
Page No.# 3/3 jurisdiction of the learned Chief Judicial Magistrate, Kamrup (M), without prior permission.
With the above observations and directions, the bail application stands
disposed of.
