Order 14/07/2025
1. The present bail application has been filed by the accused- applicants under Section 483 of the B.N.S.S., 2023 against the
order dated 03.06.2025 passed by learned Additional Sessions Judge Bhawanimandi, District Jhalawar in Bail Application
[2025:RJ-JP:26143] (2 of 3) [CRLMB-7917/2025] No.118/2025 arising out of FIR No.65/2025, registered at Police Station Unhel Nageshwar, District Jhalawar for the offences punishable under Sections 191(2), 126(2), 115(2) and 109(1) of B.N.S., 2023 and Section 5/27 of Arms Act, 1959 by which the bail application of the accused-applicants under Section 483 of B.N.S.S., 2023 has been dismissed.
2.
Learned counsel submits that accused-applicants have been falsely implicated in this case and the injured persons and accused-applicants are residents of same village. Learned counsel argues that in this matter, the incident occurred in a spur of moment, in which both the parties have suffered injuries. Learned counsel also argues that the accused-applicants also registered a cross FIR No.66/2025 at Police Station Unhel Nageshwar, District Jhalawar against the injured persons and the complainant.
Learned counsel also argues that both the parties have entered into a compromise and settled their dispute amicably and the factum of compromise is also mentioned in the impugned order dated 03.06.2025 passed by learned trial Court.
3.
Learned counsel for the accused-applicants contends that though, as per the MLR of the injured persons, they have suffered gun-shot injuries, however, none of these injuries sustained by them is dangerous to life. Learned counsel prays that the present applicants were arrested on 10.05.2025 and since then they are behind the bars and trial will take long time to conclude, therefore, the accused-applicants be enlarged on bail.
4. Per contra, learned counsel appearing on behalf of the State vehemently oppose the bail application.
[2025:RJ-JP:26143] (3 of 3) [CRLMB-7917/2025]
5.
Learned counsel appearing on behalf of the complainants admits the factum of the compromise arrived at between the parties and submits that the complainant and the injured persons have no objection if the accused-applicants are enlarged on bail.
6. Heard learned counsel for the parties and perused the case diary.
7. Considering the over all facts and circumstances of the case; looking to the period of custody; the fact that the parties have entered into compromise; investigation and trial will take long time to conclude, this court deems it just and proper to enlarge the accused-applicants on bail.
8. Consequently, this bail application filed under Section 483 of the B.N.S.S., 2023 is allowed. It is ordered that accused- applicants namely (1) Vikramlal S/o Ratanlal (2) Toofanlal S/o Ratanlal, (3) Soyatilal S/o Ratanlal, (4) Sontilal S/o Nagusingh (5) Lakhan @ Lakhuda S/o Raje Singh (6) Nagu Singh S/o Banna & (7) Jankilal S/o Bachanya @ Nathulal, arrested in connection with FIR No.65/2025, registered at Police Station Unhel Nageshwar, District Jhalawar shall be released on bail; provided each of them furnishes personal bond in the sum of Rs.50,000/- and two solvent attested sureties of Rs.25,000/- each to the satisfaction of the trial Court.
