It is further submitted that the Petitioner is the sole earning member of the family and, he is ready to abide any conditions that may be imposed by this Court, and it is urged to grant pre-arrest bail to the Petitioner. Petitioner, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioner is released on pre-arrest bail, there is a strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law. 6. As seen from the record, the allegation against the Petitioner/ Accused No.3 is that he cause produced the fake sureties before the Court concerned at the time of release of Accused therein. Learned VI Additional District and Sessions Judge, (FTC), Bapatia on 10.06.2025 in Crl.M.P.No.867 of 2025 in Crime No.107 of 2025 of Bapatia Police Station passed a quite reasoned order and dismissed the Petition filed by the Petitione for grant of Pre-arrest bail to the Petitioner. The Petitioner is a practicing Advocate.
7. In view of the gravity and nature of allegations leveled against the Petitioner, this Court is not inclined to grant Pre-arrest bail to the Petitioner. However, learned counsel for the Petitioner seeks permission to surrender before the jurisdictional Magistrate concerned and move
\ appropriate application before the concerned for his enlargement of regular bail.
8. In view of the above facts and circumstances of the case, the Criminal Petition is dismissed. However as per request of learned counsel for the Petitioner, liberty is granted to the Petitioner to surrender before the jurisdictional Magistrate concerned within a week from today and move appropriate application before the jurisdictional Court concerned. Learned jurisdictional Court concerned is directed to dispose of the application, on its own merits, in accordance with law by giving due opportunity to the Public Prosecutor concerned, within a period of two (02) days thereafter.
