1. This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in Crime No. 284/2024 registered at Police Station Churcha District Korea, Chhattisgarh for the offences under A ANNAJEE RAO Digitally signed by A ANNAJEE RAO
2 Sections 137(2), 64(1), 87 of Bhartiya Nyay Sanhita, 2023 and Section 04 of the POCSO Act, 2012.
2. The prosecution case is that on 14.12.2024, the applicant has enticed away the minor girl from the custody of her parents on the pretext of marriage and committed sexual intercourse thereby the offence has been committed.

Learned counsel for the applicant submits that the prosecutrix and the applicant were in love relations and the prosecutrix has voluntarily accompanied the applicant. He further submits that when the prosecutrix wanted to marry with the applicant, her parents did not agree for the reason that the applicant belonged to a lower caste. He submits that the applicant is in jail since 16.12.2024 and looking to his custody period, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that the victim girl and her mother have been examined.
5. Despite service of notice to the complainant/informant, no body has chosen to appear before this Court to raise their objection regarding grant of bail.

Having considered the submission of the learned counsel for the parties and the fact that the victim and her mother have been been examined and cross-examined, I am not inclined to release him on regular bail. Accordingly, the bail application is rejected. However, the trial Court is directed to expedite the trial and to ensure that the trial is concluded as early as possible. Sd/-
