GP FOR IRRI AND CAD (AP) 5 The Court made the following Order: The present Writ Petition was filed under Article 226 of the Constitution of India seeking the following relief:- “…. to issue Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in changing the alignment of kundu-Penna flood flow canal by constructing the drop in the stream at 17.915 Kms as per the client prepared on 4.12.2017 in deviation of the earlier plan after the land acquisition as illegal, arbitrary and consequently direct the respondents not to alter the alignment, which was prepared by the respondent irrigation authorities dated 12.3.2008and to pass such other order or orders….” 2. When the writ petition came up for admission on 23.04.2018, this Court was pleased to pass the following interim order in I.A.No.1 of 2018: There shall be a direction to the Respondents not to meddle with the properties of the petitioners herein, if the properties of the petitioner do not form part of the proceedings already initiated. However, it is open to the Respondents to proceed in accordance with law. 3. Today, when the writ petition came up for hearing, the learned Assistant Government Pleader furnished a copy of the instructions of the Executive Engineer, M.I. Division, Kadapa, vide Letter No.EE,M.I. Kadapa/DB/572 M, dated 06.09.2025, wherein, it is stated that though they have filed counter affidavit, duly enclosing vacate stay petition, stating that the alignment of the Kundu-Penna link canal is changed, as per the recommendations of the technical committee and designs only and further stated that after completion of the LP schedules, the land acquisition procedure is to be followed as per the Land Acquisition Act, 2013 for the changed alignment, but, however, it is stated that as on today, the contractor 6 has stopped the work and applied for pre-closure of the work due to land acquisition problems on 20.12.2021 and at present the land acquisition process for the above said work is stopped and also stated that as the land acquisition proposals itself have been stalled, there is no such change of alignment as stated by the petitioner. 4. In view of the fact that the land acquisition proposals itself have been stalled, the question of changing the alignment also does not arise. 5. Recording the same, the Writ Petition is closed.
