2. The petitioner is apprehending his arrest in connection with Jasidih P.S. Case No. 142 of 2023, registered under sections 414/ 34 of the I.P.C. under section 4/21 of MMDR Act, 1957 and Rules 4/54 of JMMC Rules, 2004, pending in the Court of learned Chief Judicial Magistrate, Deoghar.

Learned counsel for the petitioner submits that the petitioner is driver of the vehicle in question and he has no criminal antecedent. He submits that even quantity of alleged sand has not been disclosed in seizure list. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that alleged illegal sand has been loaded in the vehicle in question.

Considering that petitioner is a driver of the vehicle in question and he has no criminal antecedent and even quantity of alleged sand has not been disclosed in seizure list, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner above named, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Deoghar, in connection with Jasidih P.S. Case No. 142 of 2023, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
