Learned counsel for the petitioner would submit that the petitioner is the legal heir of the original pattadar and possessor of Ac.0.40 Cents out of Ac.5.47 Cents in Sy.No.351-2, situated at Rolla Village and Mandal, Sri Satya Sai District. Pursuant to which, the petitioner filed an application before respondent No.4 for mutation and for grant of pattadar passbook in respect of the subject land. Without conducting detailed enquiry, Respondent No.4 issued proceedings dated 22.05.2025 rejecting the claim of the petitioner on the ground that there are existing mutations in favour of other pattadars. Hence, the present Writ Petition. 3. On the other hand, learned Assistant Government 4. Pleader for Revenue furnished Written Instructions dated 07.07.2025 wherein it is stated instead of preferring statutory appeal before the appellate authority/Revenue Divisional Officer, Penukonda, the petitioner has approached this Court, which is unsustainable in law and the Writ Petition itself is not maintainable. It is further stated that the Village Revenue Officer served Form-8 Notfoenjated 28.04.2025 to the petitioner. s 4 5. Considering the submissions of learned counsel for the petitioner, learned Assistant Government Pleader and on perusal of the material available on record, it is observed that the entire land to an extent of Ac.5.47 Cents in Sy.No.351-2, situated at Rolla Village and Mandal, Sri Satya Sai District was mutated in favour of pattadars but as far as claim of the petitioner in respect of Ac.0.40 Cents out of Ac.5.47 Cents be considered by conducting a detailed enquiry after providing an opportunity of hearing to the petitioner as well as respondents. 6. In view of the same, the petitioner herein is directed to prefer an appeal before respondent No.3 within a period of three (03) weeks from the date of receipt of a copy of this order and on receipt of the same, respondent No.3 shall consider and dispose of the same in accordance with law, by providing an opportunity of hearing to the petitioner and all other stake holders if any, including the respondents, within a period of six (06) months thereafter. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. \ IS> 5 8. Till such time, both the parties are directed to maintain Status Quo obtaining as on today in respect of amendment to revenue entries, with respect to subject property.
