JUSTICE A.GUNESHWAR SHARMA 7.8.2025 Heard Mr.N.Ibotombi, learned senior counsel assisted by Ms.Jinita, learned counsel for the applicant writ petitioner and Mr.H.Devendra, learned Dy.A.G, Manipur assisted by Mr.Dimalkumar Haobam, learned Jr.Govt counsel on behalf of the State respondents. By the present application, the petitioner prays for stay on the execution of the work at Chairen Mangjin under Work Order No.EE-II/EEW/T-17/2002/WO/32 dated 8.8.2022 issued by the Executive Engineer, Div-II, Education Engineering Wing (EEW), Government of Manipur. It is stated that State Government has taken step for construction of the said School at Chairen Mangjin. It is stated that vide order dated 14.11.2022 passed by this Court in WP(C) No.961 of 2022 there is stay on the shifting of the School from Laingoubi to Chairel Mangjin till date. Vide another order dated 21.2.2023 passed in MC (WP(C)) No.52 of 2023 this Court directed the respondents to restrain from doing any construction works on the basis of work order dated 8.8.2022 for construction of the said school and hostels. On the other hand Mr.H.Devendra, learned Addl. A.G, Manipur, draws attention of this Court to order dated 11.7.2025 passed by this Court in the main W.P(C)) No.961 of 2022 and pending applications where the Court modified the interim orders and permitted the State to operate the school from NSCBAV (Kumbi) at the Kumbi Central High School as temporary measure and subject to the subject to the outcome of the writ petition. In para-9 of the order dated 11.7.2025, the MC (WP(C)) No.239 of 2023, MC (WP(C)) No.289 of 2024, MC (WP(C)) No.509 of 2024 and MC (WP(C)) No.52 of 2023 were disposed of and only the main matter was ordered to be listed for further proceedings. It is also stated that the matter is referred to the Mediation for an amicable settlement. Mr.H.Devendra, learned Addl. A.G, Masnipur submits that the present application is not maintainable as the interim orders dated 21.2.2023 is merged with the disposal of the said application vide order dated 11.7.2025. This Court is of the view that the matter may be heard on merit even if the School is constructed, everything will be subject to the outcome of the writ petition.
