This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of regular bail to the applicant who has been arrested in connection with Crime No.644/2024 registered at Police Station Telibandha, District Raipur (C.G.), for the offence punishable under Sections 318(4), 61 of BNS.
2. As per prosecution story in brief, it is alleged that the applicant REKHA SINGH Digitally signed by REKHA SINGH
2 and other accused persons with intention to cheat the complainant received Rs. 99 lakh through various mobile numbers on various occasion by inducing to invest in the trading share market, thereafter, offence has been registered against the applicant and co-accused, subsequently they were arrested. Hence, the bail application.

Learned counsel appearing for the applicant submits that the present applicant has been falsely implicated in the crime in question. He further submits that the charge-sheet has been filed in this case. The applicant is in jail since 07.11.2024 and trial is likely to take quite long time for its conclusion, therefore, he prays grant of bail to the applicant on the ground of parity. He also submits that the co-accused person namely, Sameer Thorat has already been enlarged on bail by this Court in MCRC No.1093 of 2025 vide order dated 08.05.2025, therefore, the applicant may be enlarged on bail. 4. On the other hand, learned State counsel, opposes the bail application and submit that the charge-sheet has been filed in the present case before the Competent Court. He further submits that as far as present applicant is concerned, the case of the present applicant is entirely different from the facts of the case of co-accused namely, Sameer Thorat who has been granted bail by this Court as the amount of Rs.10,00,000/- has
3 been transferred to the account of the present applicant, therefore, account has been misused. It is further stated that the present incident is of Uttar Pradesh and the present applicant is residing in Delhi, therefore, the bail application deserves to be dismissed. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the present case, nature of allegation and further the fact that the applicant/accused along with other co-accused entered into a criminal conspiracy to commit online fraud and in furtherance of the same, deceived the complainant through various mobile numbers and with dishonest intent induced him to invest Rs. 99 lakhs in share trading, out of which the applicant invested different amounts in share trading on different dates and thus caused wrongful loss of Rs. 99 lakhs to the applicant and earned wrongful profit. So far as the case of the co-accused namely, Sameer Thorat who has been granted bail by this Court is concerned, his case is completely distinguishable from that of the present applicant as the amount of Rs.10,00,000/- has been transferred to the account of the present applicant, as such, this Court is of the opinion that it is not a fit case to enlarge the present applicant. 4

Accordingly, the bail application of applicant- Deepak involved in Crime No.644 of 2024, under Section 318(4), 61 of the B.N.S. at Police Station – Telibandha, District – Raipur (C.G.), is rejected. 8.
