2. Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 3. Though the petitioner made several allegations against the respondents, during hearing, learned counsel for the petitioner requested
this Court, without touching the merits of the case, to issue a direction to the respondents, more particularly, respondent No.3 herein to consider and dispose of the Appeal dated 28.08.2024 vide ROR/4554/2023 preferred by the petitioner herein. On the other hand, learned Government Pleader for the
4. respondents submits that respondent No.3 (DRO) herein is the appellate authority but, by virtue of Act 8 of 2025 (Andhra Pradesh (Record of Rights in Land and Pattadar Pass Books) (Amendment) Act, 2025) respondent No.4 (RDO) is made as appellate authority. Accordingly respondent No.4 is the appellate authority. Therefore, let there be a direction to respondent No.3 herein to forward the appeal dated 28.08.2024 preferred by the petitioner herein to respondent No.4. On receipt of such appeal, respondent No.4 herein would consider and dispose of the same, in accordance with law, within a reasonable time. 5. In view of the submission made by the learned Government Pleader for Revenue, this Court need not decide the truth or otherwise of the allegations made in the petition.
This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh^”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do not serve to the 2019 (8) SCALE 544
of justice. As the learned counsel for the petitioner himself requested to issue a direction to dispose of the Appeal, this Court find no other alternative except to issue such direction. cause Accordingly, the writ petition is disposed of, with the following
6. directions; Respondent No.3 is directed to forward the Appeal dated 28.08.2024 preferred by the petitioner herein to respondent No.4 within a period of one month from the date of receipt of a copy of this order. i) On receipt of such Appeal, respondent No.4 is directed to consider the same and pass appropriate orders, after providing opportunity of hearing to all the parties concerned, within a period of three (03) months, thereafter. In the meanwhile. Status quo obtaining as today shall be maintained by all the parties concerned in respect of the petitioner’s possession of the subject property. ii) on There shall be no order as to costs.
