Gogoi, learned counsel for the petitioner and also heard Mr. S. Dutta, learned Senior counsel assisted by Ms. M. Choudhury, learned counsel for the respondent. This application under Section 24 of the Code of Civil Procedure, 1908 is preferred by the petitioner for transfer of Misc.(Guradianship) Case No.03/2019 pending before the Page No.# 2/2 Court of learned Additional District Judge, Goalpara to the Court of learned Principal Judge, Family Court, Kamrup(M), Guwahati or Karmup(R) or to the Nalbari district. Mr. Gogoi, learned counsel for the petitioner submits that the respondent herein has instituted the Misc.(Guardianship) Case No.03/2019 before the Court of learned Additional District Judge, Goalpara, but the petitioner herein is presently residing at Nalbari and it is difficult on her part to contest the aforementioned proceeding before the Court of learned Additional District Judge, Goalpara from Nalbari and as such, Mr. Gogoi submits that the proceeding pending before the Court of learned Additional District Judge, Goalpara may be transferred to the Court of learned Principal Judge, Family Court, Kamrup(M) at Guwahati. Mr. Dutta, learned Senior counsel for the respondent submits that he has no objection in the event of transferring the proceeding of Misc.(Guardianship) Case No.03/2019 to the Court of learned Principal Judge, Family Court, Kamrup(M) at Guwahati. Taking note of the submission of learned counsel for both the parties, the Misc. (Guardianship) Case No.03/2019 pending before the Court of learned Additional District Judge, Goalpara stands transferred to the Court of learned Principal Judge, Family Court, Kamrup(M) at Guwahati. The petitioner shall obtain a certified copy of this order and place the same before the Court of learned Additional District Judge, Goalpara and on receipt of the same, the learned Additional District Judge, Goalpara shall take necessary step for transmitting the record to the Court of learned Principal Judge, Family Court, Kamrup(M) at Guwahati.
