V R REDDY KOVVURI The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 20713/2020 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue Writ, or Direction especially one in the nature of Writ of Mandamus declaring the action of the respondents 4 to 6 in supporting the 9th respondent for illegal interference with the peaceful possession and enjoyment of the petitioner’s property admeasuring an extent of Ac.5.53 cents in Sy.No.430/2C, situated in Nagisettipalli village, B.Mattam Mandal, YSR Kadapa District which is subject matter of pending suit O.S.No.32 of 2014 on the file of Hon’ble Senior Civil Judge (Fast Track Court), Rajampet at Badvel is illegal, arbitrary, highhanded and violation of Articles 14, 19, 21 and 300-A of Constitution of India and also violation of principles of natural justice and consequently direct the respondents 4 to 6 and 9 not to interfere with the peaceful possession and enjoyment of the above said property till disposal of the suit and pass…” 2. When the matter was taken up for hearing, Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents, on receipt of written instructions, would submit that no crime has been registered against the unofficial respondents, since the subject matter in the present petition is purely civil in nature, the Police have never interfered in the said civil dispute between the parties. 4. Recording the same, the Writ petition is disposed of. However, the Police are directed not to involve in the civil disputes between the petitioner and the un-official respondents without following due process of law. There shall be no order as to costs.
