GP FOR REVENUE THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION No: 15998/2025 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: “pleased to issue a Writ Order or Direction more particularly in the nature of a Writ of Mandamus by declaring the action of the respondents more specifically the 2nd respondent in not entertaining and processing the revision filed by the petitioner against the orders passed by the 3rd respondent vide D.Dis.No.D2B/1567/2019, dated 31.03.2023 as illegal, arbitrary and violative of the fundamental rights guaranteed under Articles 14, 19 and 300-A of the Constitution of India and contrary to the express provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act 1971 Consequently direct the 2nd respondent to entertain number and process the revision filed by the petitioner and pass….” 2. Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 3. Though the petitioner made several allegations against the respondents, during hearing, learned counsel for the petitioner requested this Court, without touching the merits of the case, to issue a direction to the respondents, more particularly, respondent No.2 herein to consider and pass appropriate orders on the Revision dated 31.03.2023, vide D.Dis.No.D2(B)/1567/2019, preferred by the petitioner. 4. On the other hand, learned Government Pleader for the respondents, on instructions, submits that the respondents readily agreed to dispose of the revision pending with them in accordance with law. 5. In view of the submission made by the learned Government Pleader for Revenue, this Court need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do not serve to the cause of justice. As the learned counsel for the petitioner himself requested to issue a direction to dispose of the Appeal, this Court find no other alternative except to issue such direction. 6. Accordingly, the writ petition is disposed of, directing the respondent No.2 to consider and dispose of the revision filed by the petitioner and pass appropriate orders, after providing opportunity of hearing to all the parties concerned, within a period of three (03) months. In the meanwhile, Status Quo obtaining as on today shall be maintained by all the parties concerned in 1 2019 (8) SCALE 544 respect of the petitioner’s possession of the subject property. There shall be no order as to costs.
