Devananda, learned Addl. AG assisted by Ms. N. Jyotsana, learned counsel appears for the respondent. [2] The learned sr. counsel for the petitioner filed the present MC(WP(C)) No. 811 of 2024 praying for determination from being the counsel for the petitioner as the counsel has lost contact with the petitioner. This Court issued notice to the applicant and the postal tracking report doesn’t show proper delivery. [3] In the circumstances, vide order dated 26.03.2025 of this Court and on the request of learned Addl. AG, a direction was issued to the Post Master, Moirang Post Office to verify about the status of the summon sent by consignment No. EE46250653IN to the petitioner. AG for the respondent submits a letter dated 07.04.2025 issued by the Sub Post Master, Moirang SO stating that the summon sent by consignment No. EE46250653IN was served to one Smt. Premabati Devi, Sister-in-law of Mr. Kh. Khelendro Singh, on 12.03.2025 to the address mentioned in the record of writ petition. [5] The learned Sr. counsel for the applicant/ petitioner submits that the letter was received by Sister-in-law of Mr. Kh. Khelendro. As per report, the petitioner is residing at Imphal and it may not be a proper service. [6] This Court perused the material available on records, the summon was sent to the address shown in the writ petition by speed post and received by the family member of the petitioner. Hence, the summon to the petitioner is deemed to be served. [7] Accordingly, the application for determination is allowed. [8] List the remaining cases on 22.04.2025.
