Crl.O.P.No.30926 of 2025 O R D E R The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 308(4), 74, 76, 318(4), 351(3) of BNS Act in Crime No.503 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner had illegal contact with the defacto complainant, during which defacto complainant had given her jewels to the petitioner and thereafter, petitioner refused to return the jewels. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that false and exaggerated complaint has been given. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that so far jewels have not been recovered and the investigation is pending. Hence, he 2/4 https://www.mhc.tn.gov.in/judis
Crl.O.P.No.30926 of 2025 opposed for grant of anticipatory bail to the petitioner.
5. Considering the fact that investigation in this case is pending and the so far no jewels has been recovered and it needs detailed investigation, this Court is not inclined to grant anticipatory bail to the petitioner.
