The present petition has been filed by the petitioner for the following relief: " Issue a writ, order or direction in the nature of mandamus commanding the respondent no.1 to consider the appointment of the petitioner on the post of Principal in Government Inter College in the State of U.P. in pursuance of the merit list (Annexure No.5) in accordance with law". 3. At the very outset, Sri Nisheeth Yadav, learned counsel for the respondent no.3 has submitted that as per the guidelines issued by the Apex Court, the authorities have already filled up 97 posts. Based on the said circumstances, this Court dismissed the Writ-A No.70756 of 2010 by observing that posts have already been filled up pursuant to the guidelines issued by the Apex Court. Therefore, the present writ petition may be dismissed as identical issue is also involved in the present case. 4.
