ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-

During hearing, learned counsel for the petitioner, without touching the merits of the case, requested this Court to issue a direction to the respondents not to interfere with the petitioner’s peaceful possession and enjoyment of the subject property, without following due process of law. 3. Learned Assistant Government Pleader for the respondents furnished written instructions dated 25.06.2025 issued by the 3'^'^ respondent, wherein it is stated as follows: ‘7 further submit that we have not disturbed the subject land measuring an extent of Ac. 0.10 cents In Sy.No. 11/3F
4 at Peddakurabalapalli Vilage and there is no any alienation and land acquisition proposals are pending with subject land.
Further, I submit that the District Collector, Chittoor vide 479420/2024)/2015, dated 21.05.2025 for land acquisition, proposed for development of green field airport at Kuppam In Ramakuppam Mandal in VIjalapuram, Kilakipodu, Maneendram, Ankireddipalle, Kadasinakuppam and bondalagunta revenue villages only, hence at present the land acquisition is going on the above village only and there are no land acquisition/alienation Is pending with petitioner subject land In Peddakurabalapalli revenue village, Ramakuppam Mandal..” has issued orders Roc.G5/51049e- 4, Having regard to the submissions made by the learned counsel for the petitioner and on perusal of the written instructions furnished by the learned Assistant Government Pleader for the respondents, it is observed that when the petitioner is in settled possession and enjoyment of the subject property, he cannot be dispossessed, without following due process of law in view of the law declared by the Apex Court in “Rame Gowda (dead) by L.Rs. v. M.Varadappa Naidu (Dead) by LRs.^”. Therefore, if the petitioner are in possession of the subject property, the respondents
directed not to interfere with the petitioner’s peaceful possession and are 2004(1) see 769

5. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel miscellaneous application, pending, if any, shall also stand closed.
