For Petitioner : Mr.D.Thirumoorthy For Respondents : Mr.K.M.D.Muhilan Additional Public Prosecutor O R D E R The present Writ Petition (Criminal) has been filed seeking to set aside the order dated 12.10.2025 passed by the third respondent in Na.Ka.No.16/E2PS/TVM/2025, rejecting the request made by the petitioner to conduct Kandru Vidum Thiruvizha in connection with the village temple festival and to direct respondents 1 and 2 to consider the petitioner's representation dated 15.10.2025.

Learned counsel appearing for the petitioner submitted that the petitioner, a resident of Padavedu Village, Polur Taluk, Tiruvannamalai District and a committee member of Arulmigu Sri Gengaiamman Thiru Koil, had requested permission for conducting Kandru Vidum Thiruvizha along with cultural events on the occasion of the temple festival scheduled on 19.10.2025. W.P.Crl.No.1124 of 2025 an impugned order in Na.Ka.No.16/E2PS/TVM/2025, dated 12.10.2025. Challenging the same, the present petition has been filed.

Learned Additional Public Prosecutor submitted that the Government of Tamil Nadu has amended the Prevention of Cruelty to Animals Act, 1960 and introduced Section 2(dd), which includes “erudhu vidum vizha” within the definition of “Jallikattu”. Pursuant to the same, a Government Order in G.O.(Ms) No.8 Animal Hubandry Dairying and Fisheries (AH3) Department, dated 21.01.2017, has been issued notifying the places where the erudhu vidum vizha and other events falling under Section 2(dd) of the Act can be conducted. As per the said Government
Order, there is no notified place in Tiruvannamalai District for conducting erudhu vidum vizha. Therefore, the petitioner's request has been rejected. He further submitted that if the petitioner is aggrieved, he may challenge the said Government Order itself or seek notification of a place in his district or in his village.

It is seen that, pursuant to the amendment in the Prevention of Cruelty to Animals Act, 1960, the Government of Tamil Nadu has issued a Government Order notifying certain places for conducting Jallikattu and other related events. It is submitted by the learned Additional Public Prosecutor that no such place has been notified in Tiruvannamalai District. Hence, the relief sought by the petitioner cannot be granted.
6. Accordingly, this Writ Petition (Criminal) stands dismissed. However, it is noted that the petitioner has also sought protection for celebrating the temple festival. Therefore, in the event of the petitioner submitting a fresh application seeking police protection for conducting temple festival, the respondent Police shall duly consider the same within a period of two weeks therefrom.
