09.01.2025. The case was passed over on the illness slip of Sri Sudhir Singh Chauhan, learned counsel for the petitioner on 09.01.2025 and the matter was directed to be listed on 07.02.2025, on which date, one of the counsel Sri Ashutosh Vishwakarma,
learned counsel for the petitioner had sent illness slip. Accordingly, the case was adjourned.
2. Since on 09.01.2025 and 07.02.2025, learned counsel for the petitioner had sent illness slips, therefore, the matter was directed to be listed as peremptorily. In the aforesaid backdrop, the matter is listed peremptorily.
3. When the case is called out in the revised list, Sri Sudhir Singh Chauhan, learned counsel for the petitioner bearing Advocate Roll No. A/S 2556/2013 states "that he would not get any justice from this Court, therefore, this Court should not hear the matter and the matter should be released from this Court."
4. The said accusation is directly upon the Court without there being any material or document in support of the accusation. The said accusation lowers the authority of the Court and also amounts to interference with the due course of judicial proceeding and in the administration of justice. The accusation made by the learned counsel for the petitioner that "he would not get any justice from this Court and this Court should not hear the matter" also amounts to scandalize the proceeding of the Court.
5. The Court functions on the faith of the public, and if such kind of allegations are allowed to be made upon the Court as a means to get the case released, this would not only prejudice the judicial system but it would be very difficult and impossible for the Court to function in such a scenario to dispense the justice. The allegations have been made deliberately and willfully to get the case released from this Court.
6. Prima facie, a case for Criminal Contempt of Court is made out against Sri Sudhir Singh Chauhan, Advocate.
7. Let a contempt proceeding be drawn against Sri Sudhir Singh Chauhan, bearing Advocate Roll No. A/S 2556/2013 for making accusation against the Court.
8. The Registrar General is directed to place the record of this case before Hon'ble The Chief Justice for referring the matter to the Criminal Contempt Court.
