K. Raj Kumar, Ld. Counsel for the Writ Petitioner and Sri T. Sanjeeva Rao, Ld. Asst. Government Pleader for Revenue and Sri Abdul Matheen, Ld. Counsel appearing on behalf of Sri V.V.Satish, Ld. Standing Counsel for the APCPDCL. 2. The present Writ Petition is filed seeking the following relief: “In the circumstances stated above it is prayed that this Hon’ble Court may be pleased to issue an order, writ or direction more particularly in the nature of Writ of Mandamus Under Article 226 of the Constitution of India questioning the action of the respondents in not laying the new power line and poles in the place of old power line at Ward No.8 of Chandaluru Village, Jankavarampanguluru Mandal, Bapatia District by considering the representation dated 07.04.2025 and 18.05.2025 is illegal, arbitrary and violative of Article 14, 16 and 21 of Constitution of India and against to principles of natural justice and pass such other order or orders as the Hon’ble Court may deem fit and proper in the circumstances of the case.” 3. It is the case of the Writ Petitioner that the poles situated in Gottipativari Street are not in good condition and that they are likely to break and cause damage. The Writ Petitioner has placed on record the four Photographs in page Nos. 29 and 30 of the Writ Petition. This Court has perused these Photographs and is prima facie satisfied that there is no damage to the poles which are shown in these Photographs. 4. On a pertinent query made by the Court to the Ld. Counsel for the Writ Petitioner to show that the poles are damaged, he would submit that these are the Photographs according to the writ Petitioner, where the Poles are damaged. He would also submit that the Official Respondents have admitted to this position, but not a scrap of paper has been filed to indicate that the Official Respondents have agreed or consented to the fact that the poles existing in Gottipativari Street are damaged. 3 5. In this view of the matter, this Court is of the opinion that this Writ Petition is misconceived besides being an abuse of process. 6. Accordingly, this Writ Petition is dismissed. No order as to costs. 7.
