UNNI KRISHNAN NAIR 17.03.2025 (Vijay Bishnoi, CJ) The matter comes upon for consideration of the instant Interlocutory Page No.# 2/3 Application preferred on behalf of the applicant Union of India with a prayer to condone the delay of 796 days occasioned in preferring the connected writ appeal challenging the impugned order dated 13.09.2022 passed by the learned Single Judge. Mr. A.K. Dutta, learned Central Government Counsel appearing for the applicants has submitted that various appeals have been preferred by the Union of India against the impugned order dated 13.09.2022 passed by the learned Single Judge and in those appeals, this Court was pleased to condone the delay and had also admitted the writ appeals. Mr. S.C. Biswas, learned counsel appearing for the respondent No.1 is not in a position to dispute the above facts. Considering the submission made by the learned counsel appearing for the parties, we deem it appropriate to condone the delay of 796 days occasioned preferring the connected writ appeal. Hence, this Interlocutory Application is allowed and the delay of 796 days occasioned in preferring the connected writ appeal is condoned. Registry to register the connected writ appeal and treat the same as admitted. No need to issue formal notice of the connected writ to the respondent No.1 as the said respondent is duly represented through learned counsel Mr. S.C. Biswas and notice upon the respondent No.2 in the connected writ appeal be served through the learned Standing Counsel, Comptroller and Auditor General of India (CAG).
