PUBLIC PROSECUTOR The Court made the following: 3 Order: Heard the learned counsel appearing for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner is arraigned as Accused No.1 in Crime No.65 of 2025 on the file of Atchutapuram Police Station, Visakhapatnam District. It is submitted that the petitioner and the 2nd respondent are involved in certain civil disputes and financial transactions. The 2nd respondent lodged a complaint alleging the offence under Section 420 of the IPC. It is further submitted that, though the police issued a notice under Section 35(3) of the BNSS, the petitioner was illegally confined at the police station for four days. 3. The learned Assistant Public Prosecutor submits that the police have issued a notice under Section 35(3) of the BNSS and that the investigation is in progress. 4. Recording the submissions of the learned Assistant Public Prosecutor, this Criminal Petition is disposed of with a direction to the police to strictly comply with the provisions of Section 35(3) of the BNSS and not to take any coercive steps against the petitioner without following the due process of law.
