Respondent(s) For Petitioner(s) : Shri Chandrikaditya Pandey, Advocate For Respondent(/State : Shri Abhishek Gupta, PL SUGUNA DUBEY Digitally signed by SUGUNA DUBEY Date: 2025.06.11 11:23:43 +0530 2 (Hon’ble Shri Justice Arvind Kumar Verma) Order on Board 10/06/2025 The petitioner by way of the instant petition has prayed for following reliefs: 10.1. it is prayed that this Hon’ble Court may kindly be pleased to call for the entire records of the case of the petitioner for its kind perusal. 10.2. it is prayed that this Hon’ble court may kindly be pleased to direct the respondent authorities to lodge report against respondent No.5 who has committed an offence under Section 427 of the Indian Penal Code by demolishing the house of the petitioner. 10.3. it is prayed that this Hon’ble Court may kindly be pleased to pass an order directing the respondent authorities to grant the information sought by the petitioner by application dated 24.02.2022, 10.03.2022 and appeal dated 28.04.2022. 10.4. it is prayed that this Hon’ble Court may kindly be pleased to pass an order for compensation to the petitioner against demolishing his house without any reason and without having any authority for such kind of demolition, a sum of Rs. 10 lac as he has been placed under mental agony. 10.5. it is prayed that this Hon’ble Court may kindly be pleased to direct the respondent authorities to give a small house either at the same place or any 3 other place in that particular village or the cost of the small house may be given to the petitioner at the earliest. 10.6. it is prayed that this Hon’ble Court may kindly be pleased to grant any other relief/relief’s in favour of the petitioner, which the Hon’ble Court deem fit and just in the facts and circumstances of the case including the awarding of the costs to the petitioner.” 2. As per the relief clause No. 10.2, the petitioner wants to register an offence under Section 427 of the Indian Penal Code against the respondent No.5. In clause 10.3, the petitioner had sought relief that the respondent authorities may be directed to grant the information sought by by the petitioner in his applications dated 24.02.2022, 10.03.2022 and appeal dated 28.04.2022 which are related to the RTI. However, the petitioner has not made the RTI as party and thus, it is a defective petition which has been filed by the petitioner. Counsel for the petitioner seeks to withdraw this petition with liberty to file a duly constituted petition. Counsel for the State has no objection to the above proposition.
