ORDER Challenging the findings of the trial Court in Crl.M.P.No.570 of 2025 the petitioner has preferred the present criminal revision petition. 2. Before the trial Court the petitioner who is the owner of 32 cattles filed a petition seeking for an order of interim custody of cattles which was seized by the respondent police and produced before the learned Judicial Magistrate, Dharapuram, Tiruppur district and the same was ordered to be handed over to Tirupattur Gokulasthami Gosalai. Another petition was filed before the trial Court by a third party namely Udhayakumar in Crl.M.P.No.597 of 2025 seeking for custody of 32 cattles stating that they are having sufficient place in their trust to take care of the cattles. During the course of investigation, the respondent police has handed over the 32 cattles in a trust which was formed to take care of the cattles, birds, plants and other animals under the name and style of Sri Sankara Gomatha Trust from the year 2021 onwards and if the cattles are handed over to its owner, he would butcher them. 2\7 https://www.mhc.tn.gov.in/judis
3. Further more prosecution also raised objection stating that the 32 cattles were illegally transported in a lorry bearing Registration No. KA 51- A-5095 with out proper ventilation, space and food and that the cattles were handed over to the Sri Sankara Gomatha Trust. As on date the Trust also felt some discomfort to maintain the 32 cattles. Considering all these aspects and the conduct of the petitioner who transported 32 cattles in one lorry without proper food, space and other required amenities, the trial Court held that it would not be proper to hand over the cattles to the petitioner and ordered to be handed over to the Tirupattur Gokulasthami Gosalai Trust which is having sufficient facility to maintain the cattles and accordingly ordered to be transported with proper ventilation and food at the cost of the cattle owner and thereafter the Gokulasthami Gosalai Trust to take care of the 32 cattles with good care and therefore dismissed both the petitions. Challenging the order in Crl.M.P.No.570 of 2025 dated 15.07.2025 passed by the learned Judicial Magistrate, Dharapuram, Tiruppur district, the petitioner claiming himself as owner of the cattles preferred this criminal revision petition. 3\7 https://www.mhc.tn.gov.in/judis
4.
The learned counsel for the petitioner submitted that the petitioner has purchased 32 cattles from several farmers in Andhra Pradesh and wanted to sell them at Pollachi for agriculture purpose and sought assistance with transport agency. The order of the trial Court prevented the owner of the cattles from enjoyment and usage of the cattles. Hence, the
learned counsel prays to set aside the order of the trial Court.
5. The learned Government Advocate raised objection by stating that without prior intimation the petitioner had illegally transported the cattles in a lorry bearing Reg.No.KA 51 A 5095 without adequate space, sun light, air and excessively loaded due to which the driver of the lorry was unable to control the lorry and hit against the motor cyclist who sustained minor injuries and thereafter the said injured and others have found that 32 cows cattles were loaded excessively without space, sun light and air. Therefore a complaint was lodged and cattles were seized by the police and registered FIR in Crime No.279 of 2025 under Section 281 & 125 (a) of BNS 2023 and under Section 11(1), (a), (d), (e) of Prevention of Cruelty to Animal Act, 1960 and the driver of the lorry was charged for the offence. 4\7 https://www.mhc.tn.gov.in/judis
6. Though the petitioner claim himself as the owner of the entire 32 cattles he has not elicited for what purpose was he purchased the cattles and the way he transported 32 cattles in one lorry without giving adequate space and required amenities to them shows that he is not inclined to use for the legitimate purpose and there may be lot of chances for slaughter. Though he contends that he purchased the cattles for agricultural purpose an ordinary prudent man would not purchase 32 cattles for agricultural purpose and the reason assigned by the petitioner is not acceptable. But as on date the cattles are under the safe custody of the Tirupattur Gokulasthami Gosalai as rightly held by the trial Court. On considering the entire facts of the case, the order of the trial Court does not require any interference and the order passed by the trial Court is confirmed.
7. Accordingly, this Criminal Revision Case stands dismissed. 09.10.2025 Index : Yes/No Speaking/Non Speaking order dpq 5\7 https://www.mhc.tn.gov.in/judis
