--------- For the Petitioners : Mr. Sardhu Mahto, Advocate For the Resp.-State : Mr. Mithilesh Singh, G.A.-IV
--------- 13/Dated:-12.06.2025
1.
Heard learned counsels for the parties.
2.
The instant writ application has been preferred by the petitioners praying for a direction upon the 5th respondent for giving promotional benefit from the date as given to the juniors in the promotion list (Annexure-1).
3.
At the outset, learned counsel for the petitioners draws
2025:JHHC:15546 2 attention of this Court towards Annexure-1 and submits that the name of all these petitioners was indicated at Serial Nos.96, 97, 101, 106, 108, 109 and 111. However, for the reasons best known to the 5th respondent, their names were not included in the main promotional list (Annexure-2); as such, the 5th respondent may be
directed to look into the matter and pass an order of promotion in the light of Annexure-1.
4.
Learned counsel for the respondents draws attention of this Court towards the counter affidavit filed by the 5th respondent dated 03.04.2017 and submits that on the basis of date of joining/educational qualification and service tenure, date of granting promotion in Grade-3 scale was to be ascertained and the teachers, who had submitted their Service Book and their academic certificate for verification; have been granted the Grade- 3 scale from the date of eligibility vide memo no. 1211 dated 01.04.2011, but no promotion order of rest of the teachers in all the categories (General, ОВС, SC & ST) could be issued by ascertaining the date of promotion because they have not appeared with their Service Book records.
He further submits that the then District Superintendent of Education, Ranchi has already directed all the Headmaster-cum-Drawing and Disbursing Officer of the District to submit the service books of all such teachers who have been granted Grade-3 scale, but they have not submitted their service book vide memo no. 1212 dated 01.04.2011.
5.
Learned counsel lastly submits that even now, if the
2025:JHHC:15546 3 petitioner would approach the 5th respondent by submitting the documents for verification, he will take a decision on promotion in the light of Annexure-1, which is the promotion list in which the name of all these petitioners were incorporated.
6.
Having regard to the aforesaid facts and circumstances of the case and the submissions made by learned counsels for the parties, the petitioners are hereby directed to approach the 5th respondent by filing fresh representation/(s) along with all relevant documents which is required for verification as early as possible preferably within a period of four weeks.
The moment the 5th respondent will receive the respective representation(s)/ application(s), he will look into the matter and verify the documents and pass an appropriate order in the light of Annexure-1 because admittedly, in Annexure-1, the name of all these petitioners was reflected at respective serial numbers and pass a reasoned and speaking order with regard to the claim made by these petitioners.
7.
It goes without saying that the entire exercise shall be completed within a period of 12 weeks from the date of receipt of such representation(s) / application(s) and all consequential benefits shall be extended to all these petitioners within a further period of eight weeks.
8.
Accordingly, the instant writ application stands
disposed of. Pending IAs, if any, also stands closed.
