3. The present proceedings have been initiated for challenging the judgment and order dated 18.09.2018 whereby the Title Suit No.41/2017 was stayed by the Court of the learned Civil Judge, Kamrup, Amingaon in view of Section 10 of the Code of Civil Procedure, 1908.
4. The learned counsel appearing on behalf of the respondents submits that nothing remains in the instant proceedings taking into account that Title Suit No.13/2017 which was the previous suit had already been settled by a mutual agreement dated 24.12.2024 on the basis of which the compromise decree was passed was by the learned Trial Court. The same are kept on record and marked with the letters “X” and “Y”.
5. Taking into account the above, nothing further remains in the instant proceedings for which the instant proceedings stands closed.
