A case has been registered against the petitioners herein for the offences punishable under sections 109(1) r/w 3(5) of BNS. 3. Case of the prosecution, in brief, is that, on 27.05.2025 at about 4,00 pm, the accused went to Rajaratna Bar, Mandapeta to consume alcohol and at that time the defacto complainant and some others sat opposite table of the accused and while they were consuming liquor and they were talkI|ng loudly. On that, the petitioners questioned them as to why they were talking loudly and asked them to talk softly. When the defacto complainant and others came out of the bar, the petitioners raised quarrel and Al beat with a beer bottle on the head of the injured and A2 beat him wI'th a brick On his head causing <z;' 3 bleeding injury and other persons also beat him with hands and legs with a view to eliminate him. 4. Heard the learned counsel for the petitioners and learned Assistant Public ,Prosecutor. Perused the record. 5. On perusal of the record, it appears that a quarrel took place between the defacto complainant and the accused. Under sudden and grave provocation, accused assaulted the defacto complainant with a beer bottle, resulting in the defacto complainant sustaining simple injuries. The quarrel between the parties appears to have been as a result of sudden provocation. The petitioners are in judicial remand since 28.05.2025. 6. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners/Al to A5 on the following conditions. i) The petitioners/Al to A5 shall be released on bail on their executing personal bond for Rs.10,000/-(Rupees Twenty Five Thousand only) each with two sureties of the like sum to the satisfaction of the Judicial Magistrate of First Class, AIamuru. ij) On release, the petitioners shall appear be for-e the Station House Officer concerned, once in a week i.e. on every '` .` 4 sunday, between 10-.00 am and o5.00 pm, till filing of the charge sheet and the petitioners shall make themselves available for investigatI-On aS and when required and that they shall not cause any threat, inducement or promllSe tO the Prosecution Witnesses. iji) lt is made clear that the petitioners shall scrupulously comply wI|th the above conditions and breach of any of the above conditions will be viewed seriously and prosecution is at liberty to move an applI'CatjOn for cancellation of the bail. 7.
