The present application has been filed to quash the summoning order 06.04.2016 as well as entire proceedings of Case No.899 of 2016, under Section-138 of Negotiable Instruments Act, 1881, Nikhil Garg Vs. Prerna Constructions and others, Police Station- Sikandara, District-Agra, pending in the court of Additional Chief Judicial Magistrate, Court No.1, Agra. 3. After some arguments, learned counsel for the applicants submits that he does not want to press this application and same may be dismissed as withdrawn so that he can pursue his earlier petition against the impugned proceeding, though, same was dismissed in default. 4. In view of the above request, present application is dismissed as withdrawn with the aforesaid liberty.
