For the Petitioner(s) : Mr. Mahesh Tewari, Advocate For the State : Ms. Ruby Pandey, APP For the OP No.2 : Mr. Jyoti Prasad Sinha, Advocate ------- 04/19.06.2025: This is an application filed by the petitioners praying for grant of anticipatory bail in terms of sections 482 and 484 of Bharatiya Nagrik Suraksha Sanhita, 2023, as the petitioners have been allegedly implicated in connection with Kotwali PS. Case No. 393 of 2023, for the offences punishable under sections 406, 420, 467, 468, 471, 120B of the Indian Penal Code, pending in the Court of learned Chief Judicial Magistrate, Ranchi. 2. Heard the learned counsel for the petitioners, learned counsel for the opposite party no.2 and the learned counsel for the State. 3. The learned counsel for the State and learned counsel for the opposite party no.2 oppose the prayer for anticipatory bail of the petitioners. 4. It is alleged that informant was running small canteen and he intended to extend his business by participating in a tender which was being floated by the State Bank of India for establishment of canteen. It is alleged that Mohan Kumar, an employee of bank introduced the informant with these petitioners and thereafter an amount of Rs. 30,00,000/- was given to Mohan Kumar but the informant was not allowed to set up his canteen. 5. During course of arguments it appears that no money has been paid to these petitioners. 6. The learned counsel for the OP No.2 opposes the prayer for anticipatory bail of the petitioners and submits that Mohan Kumar has introduced the informant with these petitioners and money was paid to Mohan Kumar who has stated that it is these petitioners who will help the informant in getting tender. 2025:JHHC:16091 7. Considering the aforesaid facts that money was given to Mohan Kumar who has later on introduced the informant with these petitioners, I am inclined to release the petitioners on anticipatory bail. 8. Accordingly, the petitioners, above named, are directed to surrender before the court below within three weeks from today and in the event of their surrender/arrest the learned court below is directed to enlarge them on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand)each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ranchi, in connection with Kotwali PS. Case No. 393 of 2023, subject to the condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the learned trial court indicating his/her share in the property.
