The Writ Petition is filed questioning the action of the respondents in not releasing the amounts of Rs.4,54,821/- vide M Book No. 37/2023-24, Rs.4,55,166/- vide M Book No 36/2023-24 and Rs.4,51,705/- vide M Book No.38/2023-24, even after finalizing the bills payable to the petitioner in relation to the works i.e., (i) Supply of manmazdoor and Hire basis for JCB, Zeep and sand bags for filling arrangements for watching with canal water from (Kottappa konda chamber to OLD and New SS Tanks) in Chilakaluripet Municipality, vide Agreement No.280/2023-24 dated 06.01.2024 (ii) Supply of manmazdoor, Zeep and sand bags for filling arrangements for watching with canal water from (10R majar to kottappa konda chamber) in Chilakaluripet Municipality vide Agreement No.279/2023-24 dated 06.01.2024nal @ Km92.863, GBC Escape @ Km 84.724 in Chilakaluripet Municipality vide Agreement No.307/2023-24 dated 02.3.2024 and (iii) Supply of manmazdoor and Hire charges for Electrical motors, Oil Engines, Zeep and sand bags for filling arrangements for 3 watching with canal water at (OLD & New SS Tanks Filling) in Chilakaluripet Municipality vide Agreement No 281/2023-24 dated 06.01.2024, is illegal and arbitrary. 2. Heard Sri Bathala Ramesh, learned counsel for the Petitioner and Smt.Sireesha Rani, learned Standing Counsel for the Respondent No.4-Municipality. 3. At the time of hearing, the learned Standing Counsel for the Respondent No.4 - Municipality passed on written instructions signed by the Municipal Commissioner, Chilakaluripet, which is placed on record, wherein it was stated that the execution of work by the petitioner was admitted and that the Municipal authorities have prepared the bills for payment. It is further stated that due to financial priorities, the bills of the petitioner could not be cleared. It is also stated that the Municipal Authorities are processing bills for uploading in CFMS portal on priority basis one by one on availability of funds including the petitioner’s bills. 4. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of work and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition, with the consent of both sides, with the following direction: 4 (i) The Respondent authorities are directed to pay the amounts due to the Writ Petitioner within a period of four (04) months from the date of receipt of the copy of this order. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
