ORDER:- This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-

learned counsel for the petitioners and learned Government Pleader for the respondents.

Learned counsel for the petitioners submits that the petitioners’ father is the original pattadar and possessor of the land admeasuring to an extent of Ac.4.10 cents in Sy.No.118-D of Varagani Village, Medikonduru Mandal, Guntur district, having acquired the same through registered adoption deed. Since then, petitioners’ father has been in peaceful possession and enjoyment of the subject property. For which, the revenue authorities issued pattadar pass book and mutated the name of the petitioners’ father in the revenue
5 records. While so, the petitioners’ father herein executed deed, wherein, petitioner No.1 got Ac. 1.00 Ac.2.00 cents and petitioners’ and that Ac.0.10 cents a registered partition if-H cents and petitioner No.2 got remaining Ac. 1.10 cents is vested with the father of was corrected in the revenue records long back as per the Survey and Ac.0.10 cents was in Sy.No.120/2. Due to the partition between the petitioners and their father, the Sy.No. 118-D was sub divided as D1 & D2 and the total Ac.4.00 cents was sub-divided between were issued IB Register, pattadar pass year 2017. Since then the petitioners have been in them. Accordingly, the petitioners books in their favour in the separate possession and enjoyment of their respective extents of land. While things stood thus, to the surprise of the petitioners, the without following due process of law unofficial respondents as contemplated under Section 5 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act 1971 (in short Act 26 of 1971’) mutated the name of the respondent No. 13 in the revenue records in respect of Ac.1.00 cents in Sy.No.118-D. Pursuant to the said mutation, respondent No. 13 alienated the subject land in favour of respondent No.14 on 22.04.2025.

Learned counsel for the petitioner further submits that due to the re- survey and wrong entries made, respondent No. 13 illegally got mutated alienated the subject land and in favour of respondent No.14 without there being any right, whatsoever. For which, the father of petitioners herein submitted representation dated 11.03.2024 requesting for correction of entries in favour of the petitioners. Even though the representation was received by the
6 respondents, so far, the respondents neither considered the same nor issued any other proceedings. Hence, the writ petition. 5. On the other hand learned Government Pleader for the respondents furnished written instructions dated 08.07.2025 issued by the Tahsildar, wherein, the relevant portion of the said instructions is extracted hereunder:
“It is submitted that aggrieved by the above speaking endorsement issued to the said Danda Siva Reddy who is the father of the present petitioners he has got filed the present Petition. The Petitioners herein along with their father never responded to the Notices issued by the 7^^ Respondent herein and did not preferred to resolve their issue duly coordinating with the field functionaries of Revenue and Survey Departments in redressing the grievance amicably in the interest ofjustice. It is submitted that moreover the Petitioners herein has got a remedy by filing an appeal before the Mobile Magistrate and Deputy Tahsildar, Resurvey on the Resurvey related issue for their enquiry and redressal. They have not even preferred to avail and exercise this remedy available as per the provisions of Resurvey. 6. Learned Government Pleader further submits that when the respondent No.7 received an application from the respondent No. 13 seeking mutation, the petitioners were issued notices in compliance of Section 5 of the Act 26 of
1971. But, none of the petitioners turned up to the notices. Thus, the respondent No.7 has proceeded further in accordance with law. 7. In reply, learned counsel for the petitioners submits that since from the date of change of revenue entries/ amendment of revenue records, the
7 petitioners have continuously submitted representations requesting the respondent No.7 to amend the revenue records as per their entitlement. 8. Having regard to the submissions made by the learned counsel for the petitioners and learned Government Pleader for the respondents and perusal of the material placed on record, the fact remains that the petitioners and their father are the original joint patta holders in respect of the subject property.
As such, the subject land was sub-divided and mutated in favour of the petitioners as well as their father. Accordingly, they were issued pattadar pass books, in respect of their respective extents, as entitled by them. It is further observed that the respondent No. 13 also got mutated as pattadar in respect of Ac.1.00 cents in Sy.No.118-D of subject village under the provisions of Section 5 of the Act 26 of 1971. The written instructions submitted by the learned Government Pleader indicates that they followed the procedure and issued notices to the petitioners herein while proceeding with the mutation. Since there is no response from the petitioners, they proceeded further and mutated the subject land in favour of respondent No. 13. Pursuant to the said mutation, respondent No. 13 alienated the subject land in favour of respondent No. 14, but, so far no mutation has been taken place in favour of respondent No. 14. on

In view of the foregoing discussion, the writ petition is disposed of, directing the respondents to consider the representation dated 11.03.2024 submitted by the petitioners and pass appropriate orders in accordance with the Section 5 of the Act 26 of 1971 within a period of three (03) months from
8 r the date of receipt of a copy of this order. In the meanwhile, the respondents are
directed not to act upon the sale deed dated
22.04.2025. However, respondent No.7 shall not entertain any mutation application in respect of the subject land in favour of respondent No. 14. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
