For the State Mr. Subham Mishra, AC to SC (Mines)-II ------ 11/05.02.2025: In this writ petition, the petitioner has prayed to reckon his date of annual increment to be from the 1st of January and not from the 1st of April as mentioned in Annexure-2 to the writ petition. 2. It is the case of the petitioner that in column No. 6 of Annexure-2 to the writ petition at page 20, the date of annual increment has been fixed as 1st January, but in column No. 8, the date of such increment has been fixed from 1st April, 1998 and not 1st January. He submits that this anomaly be corrected. 3. After hearing the parties, I find that admittedly the petitioner was in the pay scale of Rs.5000-150-8000/-. He was given promotion in the pay scale of Rs.5500-175-9000/-. This promotion was given with effect from 1st of April, 1998. When the promotion as well as monetary benefit was given effect from 1st April, 1998, the annual increment for each year will fall due on 1st of April, 1998. Thus, his date of annual increment cannot be pushed back to 1st of January. On 1st April of each year, he will get the increment @ Rs. 175/-. Thus, no illegality has been committed by the respondents. 4. Accordingly, this petition is dismissed being devoid of any merit. Anu/-Cp2. (ANANDA SEN, J. )
