Case of the prosecution, in brief, is that on 10.O1.2025, the Sub- Inspector of Police along with his staff and mediators rushed to panneda Junction, and caught the accused in possession of 398 Kgs of Ganja. The contraband along with other material was sel-zed under the cover of mediators report. The accused were arrestec] and got remanded to judicI-al Custody. 3. Heard. Perused the material on record. Learned counsel for the petitioner COntended that the Petitioner was arrested on 10.01.2O25 and since then he has been in judicial custody and that statutory period of 180 days is completed and POIice have not filed charge sheet and prays to enlarge the petitioner on bail. 5. On the other hand, learned Assistant Public Prosecutor also confirms non-filing of charge sheet by the police even after statutory period is completed, but opposed to grant bail. 6. As seen from the record, the petitioner Was remanded tO judicial custody on 10.01.2025 and charge sheet has not been filed. Most of the witnesses are shown to be official witnesses and the release of the petitioner would not cause hampering of investigation. l`t is submitted that the petitioner had permanent abod`e and there is no possibility of his fleeing away from justice. 7. ln view of the aforesaid facts and circumstances Of the Case, this court is inclined to grant bail to the petitioner herein With the following conditions: i. The petitioner herein/A3 shall be released on bail on his execJting a personal bond for Rs.1,00,000/-(Rupees one lakh only) with two (o2) sureties for a like sum each to the satisfaction of the learned I Addition,al District and Sessions Judge-Gum-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam. <._` _-e-. ii. On release, the petitioner shall appear before the station House Officer concerned, twice in a week i.e., on every wednesday and Sunday between 10.00 AM and 01.00 PM., for a period of four (4) months. iii.
