Medhi, learned counsel appearing for the petitioner as well as Mr. D. Das, learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, Bishal Page No.# 2/2 Paul has prayed for releasing him on regular bail, after he was arrested in connection with Gorchuk P.S. Case No.390/2024. 3. It is alleged in the FIR that the petitioner had kidnapped one 14 year old girl. Later on police recovered the girl. She made a statement before the Magistrate stating that she was in love with the petitioner and pursuant to that, she had eloped with him on her own. 4. I have considered the submissions made by the learned counsels of both sides. 5. The girl may be a minor one, but she had attained the age of understanding. She had eloped with the petitioner on her own. 6. This Court is of the opinion that the petitioner does not deserve to be detained in custody. 7. Accordingly, the bail application of the petitioner is allowed. 8. It is hereby directed that the petitioner, Bishal Paul, was arrested in connection with Gorchuk P.S. Case No.390/2024, shall be released on bail of ₹ 20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro) at Guwahati, Assam. The bail application stands disposed of accordingly. The CD shall be returned. JUDGE Comparing Assistant
