Apprehending arrest in connection with Rangia GRPS Case No. 13/2023, under Section 381 of the IPC, this application under Section 482, BNSS has been preferred by applicant, namely, Monsur Ali @ Mansur Ali, for grant of pre- arrest bail. 3. It is to be noted here that the aforementioned case has been registered on the basis of an FIR lodged by one Amit Barai on 01.04.2023. The essence of allegation in the FIR dated 01.04.2023, is that the informant had loaded 646 (Nos) M. Oil (639 C/S 500 ml PB + 7 C/S 1 Ltr PB) on a truck, bearing Registration No. AS-01-AA-9409 from wagon No. 11606, vide challan No. 3850, dated 31.03.2023, at Changsari Goods Railway Yard to Nalapara Godown. But, the said truck has not reached M/s Bunge India Pvt. Ltd., Nalapara Godown till now and he suspects that the aforementioned consignment of M. Oil had been stolen by the driver Boga Ali. 4. Mr. Choudhury, learned counsel for the applicant submits that the applicant had been granted the privilege of interim pre-arrest bail, vide order dated 19.12.2024, and pursuant to the said order, he has also appeared before the I.O., and as per his information, the I.O. has completed investigation and submitted charge-sheet. 5. Mr. Sarma, the learned Additional Public Prosecutor also submits that after completion of investigation, the I.O. has laid charge-sheet, being charge-sheet No. 28/2024, dated 30.09.2024. 6.
In view of the submissions of learned Advocates of both sides, this Court is inclined to dispose of this application by directing the applicant to appear before the learned trial Court on or before 14.02.2025, and to apply for regular bail and in the event of such an application, the learned trial Court shall consider the
