1. The petitioner has preferred this petition under Section 439(2) of the CrPC against Order dated 15.9.2021 passed by this Court in MCRCA No.155/2021 (Ankit Vyas vs. State of Chhattisgarh), whereby anticipatory bail has been granted to the applicant/respondent No.2 herein.
2. At the outset, learned counsel for the State/respondent No.1 submits that in respect of crime No.34/2016, charge sheet has been filed against respondent No.2 on 14.8.2023 and the same has been registered as Criminal Case No.173/2023. 3. In view of the aforesaid contention of learned counsel for the State,
learned counsel for the petitioner submits that since charge sheet has been filed, he does not want to press this petition, hence, the same may be
disposed of.
4. Having considered the aforesaid contention of learned counsel for both the parties, since the petitioner does not want to further prosecute this petition, this petition is disposed of as not pressed.
