MAHADEVA KANTHRIGALA Counsel for the Respondent(S): 1.GP FOR REVENUE The Court made the following; :: ORDER :: The above writ petition has been filed to declare the action of respondent No.6 in not processing the documents presented by the petitioners SRS,J W.P.No.15763 of 2025 for registration in respect of Plot Nos. 125, 126, 224, 225, 226 & 227 in Sy.Nos.693, 695, 696, 697 & 851 of Basinikonda Revenue Village, Madanapalli Mandal, Annamayya District, as illegal and arbitrary. 2. Heard Sri K. Mahadeva, learned counsel for the petitioners, and Sri G. Divya Theja, learned Assistant Government Pleader for Stamps and Registration, appeared for respondents 1 to 6. Learned counsel for the petitioners would submit that the 1®‘ petitioner is the absolute owner of Plot Nos.224, 225, 226 & 227 in Sy.Nos.693, 695, 696, 697 & 851 of Basinikonda Revenue Village, Madanapalli Mandal, Annamayya District. The 1®' petitioner purchased the plots through a registered sale deed dated 22.01.2021. The 2"'^ petitioner is the absolute owner of plot Nos.125 & 126. The petitioners intended to alienate the plots and submitted documents for registration. Respondent No.6 received the documents and assigned P.Nos.30, 31, 32, 33 & 34, and did not process further, due to pendency of the suit in O.S.No.51 of 2023 on the file of the learned II Addl. District Judge, Madanapalli. Learned counsel would also submit that respondent No.6, having assigned P.Nos.30, 31, 32, 33 & 34 to the documents presented by the petitioners, ought to have processed or passed an appropriate order. 3. ) ] 4. Learned Assistant Government Pleader, on instructions, would submit that respondent No.6 will pass appropriate orders on the documents presented by the petitioners in respect of the aforementioned plots. 5. Whenever a document is presented, the registering authority shall receive and process the same, subject to the fulfilment of the provisions of the Registration Act, 1908 and the Indian Stamp Act, 1899. Unless a restraint order is passed by a competent Court or the property is included in the list of prohibited properties under Sec 22A of the Registration Act, the registering authority shall not refuse to register the document. In case of any impediment. SRS,J W.P.No.15763 of 2025 the registering authority shall pass a refusal order under Section 71 of the Registration Act. Given the facts and circumstances of the case, the Writ Petition is disposed of at the stage of admission with the consent of both the learned counsel, directing the respondent No.6 to pass appropriate orders regarding the documents presented by the petitioners in respect of Plot Nos. 125, 126, 224, 225, 226 & 227 in Sy.Nos.693, 695, 696, 697 & 851 of Basinikonda Revenue Village, Madanapalli Mandal, Annamayya District, as expeditiously as possible, preferably within four (04) weeks.
