Heard Mr. J. Jini, learned counsel for the applicant. 2. This application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, (BNSS) 2023 has been filed by the applicant, who is the wife of the accused person, Shri Mijum Ango, who has been incarcerated in connection with Itanagar Women P.S. Case No. 55/2025, under Section 75(2) of the BNS, 2023, read with Section 10 of the Protection of Children from Sexual Offences Act,
2012. 3. The learned counsel for the applicant submits that the accused has been languishing in judicial custody since 20.08.2025.
It is stated that the case has already been charge-sheeted and the trial has commenced and, therefore, there is no requirement for further custody of the accused person. It is also stated that the applicant had moved a bail application, being B.A. No. 457/2025, before the learned Special Judge, Yupia, which was rejected by order dated 12.11.2025, primarily on the ground that the accused is a neighbour of the victim and that there is a possibility of tampering with the witnesses. The learned Trial Court also observed that the victim is yet to be examined and, therefore, the application was rejected. 4. Also heard Ms. T. Jini, learned Additional Public Prosecutor for the State and Mr. U. Bori, learned legal aid counsel for the respondents No. 2 and 3, who submit that this is a case where the victim is a minor and the accused is a
Page No.# 4/4 neighbour of the victim, and the possibility of intimidation cannot be ruled out; therefore, it is prayed that the present bail application may be rejected on this ground alone. 5. This Court has considered the submissions of the learned counsel for the parties and has also perused the records. 6. It is seen that the trial has commenced; however, the victim is yet to be examined, and therefore, this Court is of the view that the possibility of threat and intimidation cannot be ruled out at this stage. More so, when the accused is a neighbour of the victim and the victim is a minor child. Accordingly, the bail application stands rejected. JUDGE Comparing Assistant
