IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA. LPA No.214 of 2023 Decided on: 19.05.2025 Professor Anupama Singh ......Appellant Versus Himachal Pradesh University & Anr. ...Respondents Coram Hon’ble Mr. Justice G.S. Sandhawalia, Chief Justice Hon’ble Mr. Justice Ranjan Sharma, Judge Whether approved for reporting?1 For the appellant : Mr. R.K. Bawa, Sr. Advocate with Mr. Ajay Kumar Sharma, Advocate. For the respondents : Mr. Anup Rattan, Sr. Advocate with Mr. Devender K. Sharma, Advocate. G.S. Sandhawalia, Chief Justice (Oral) The present appeal filed by the appellant- petitioner, arises out of the order passed by learned Single Judge in CWP No.3440 of 2023 on 17.11.2023, who dismissed the writ petition. The issue in question as such was whether the extraordinary leave granted to the writ 1 Whether the reporters of Local Papers may be allowed to see the judgment? petitioner as such w.e.f. 21.04.2022 to 20.04.2025 was liable to be cancelled as had been ordered/done by the Registrar of the University on 08.05.2023 in the name of Executive Council. The said order had been stayed by learned Single Judge at the initial stage on 02.06.2023, when the writ petition was entertained. The said order was further continued in present Letters Patent Appeal on 24.11.2023. 2. We are now informed that the appellant had joined back after completion of the extraordinary leave. Resultantly, we are of the considered opinion that the issue now has been rendered academic since the appellant had already joined back and, therefore, no fruitful purpose would be served upon by adjudicating the issue in question. 3. Since the appellant-writ petitioner had worked during the said period as Pro-vice Chancellor of Sardar Patel University, Mandi, Himachal Pradesh, for a period of three years, due to the said fact, no adverse action would be taken against her in not joining back in consequence of the impugned order dated 08.05.2023, since this Court had already protected her during the pendency of the litigation. 4. The appeal is accordingly disposed of. Pending miscellaneous application(s), if any, shall also stand disposed of. (G.S. Sandhawalia) Chief Justice May 19, 2025 (Ranjan Sharma) (Yashwant) Judge
